User agreement
This document “User Agreement” (further — Agreement) is a proposal of ANO “NEW HOLLAND” posted on the shop.newhollandsp.com website (further — “Website”), to conclude a contract on the terms of the Agreement below.
1.General provisions
1.1. You hereby confirm that from the moment you register on the Website and during the time you use the Website, as well as the Website’s personalised services, you are a User of the Website up to the moment of your personal request addressed to the Website’s administration to terminate your relationship with the Website.
1.2. Use of the Website in any way and in any form within its declared functionality, including:
a) viewing of the content on the Website;
b) registration and/or authorisation on the Website;
c) posting or displaying any material on the Website, including but not limited to texts, hypertext links, images, audio and video files, data and/or other information;
establishes a contract under the terms of this Agreement in accordance with the provisions of Articles 437 and 438 of the Russian Civil Code.
1.3. By using any of the above features of the Website, you confirm that you have:
a) read the full terms of this Agreement prior to using the Website;
b) accepted all the terms of this Agreement in full without any exemptions or restrictions on your part and commit to comply with them or terminate the use of the Website. If you do not agree with the terms of this Agreement or are not entitled to a contract based on them, you should immediately cease any use of the Website;
c) The Agreement (including any of its parts) can be changed by the Website without any prior notice. The new version of the Agreement takes effect from the moment it is posted on the Website or brought to the user’s attention in a different way, unless the new Agreement states otherwise.
2. General terms of use of the Website
2.1. The Website sells products through the shop.newhollandsp.com web resource and related services of the Website.
2.2. The Website delivers products in ways defined in Part 5 of this Agreement.
2.3. The Website provides access to the Website’s personalised services in order to obtain the most definitive information on the products you are interested in, create ratings and polls, participate in competitions and other promotions organised by the Website.
2.4. Hereby you give your voluntary consent to be informed about all the Website’s activities related to the sale of goods and/or services, including the status of the order, as well as other events related to the services of the Website.
2.5. Consent to receive e-mails:
By subscribing to mobile text messages and emails from shop.newhollandsp.com or third parties authorised to send emails on behalf of shop.newhollandsp.com, I agree to receive emails to the phone number and email address I provided when registering through the subscription service for the informational emails on the shop.newhollandsp.com website. I have been informed that if I wish to opt out of the shop.newhollandsp.com emails, I will need to go to the “Unsubscribe from Emails” link listed in the text of the emails/messages sent by the Website from the email address of shop@newhollandsp.com or notify through any of the addresses listed in “Contacts” section of the Agreement about my dissent to receive the emails. I also authorise the Website or third parties authorised to send emails and texts on behalf of the Website to collect, store and process all personal information I have submitted to the Website (including name, surname, patronymic name and email address) in order for the Website to inform me of news and any other events on the Website.
2.6. You agree that the Website is not responsible for any delays, failures, incorrect or late delivery, removal or failure to release any notifications. At the same time, the Website reserves the right to re-send you any notification, if it has not been received by you.

2.8. You recognise that the accompanying product description on the Website does not claim to be exhaustive and may contain inaccuracies. You have the right to send all comments on an inaccurate description of the product to the Website at shop@newhollandsp.com
2.9. You recognise that the Website is working hard to ensure that the appearance, packaging and characteristics of the products are consistent with the description in the Website’s catalogue. At the same time, the Website brings to your attention the fact that the actual appearance, packaging and characteristics of the product may differ from its descriptions in case of it being an assortment product, as well as in the case of changes to the product made directly by the manufacturer.
2.10. You have been informed that the price and availability of products on the Website changes 24 hours a day without any notice and are specified in the individual status and detailed card of the product displayed in the Catalogue of the Website.
3. User Liabilities when Using the Website
3.1. You agree not to use the Website’s services for the purpose of:
3.1.1. uploading content, that is illegal, violates any rights of third parties; promotes violence, cruelty, hatred and/or discrimination on the basis of race, nationality, sex, religion or social grounds; contains inaccurate information and/or insults against specific individuals, organisations, authorities;
3.1.2. incentives to commit illegal acts, as well as to assist persons whose actions are aimed at violating the restrictions and prohibitions operating on the territory of the Russian Federation;
3.1.3. violating the rights of minors and/or causing them harm in any form;
3.1.4. infringement of minority rights;
3.1.5. passing yourself as another person or representative of an organisation and/or community without sufficient rights, including the staff of the Website;
3.1.6. providing misleading information about the properties and characteristics of any items from the catalogue on the Website; incorrect comparison of products, as well as inducing negative treatment of persons (not) using certain products, or condemnation of such persons;
3.1.7. uploading of content that you are not allowed to make available according to Russian law or under any contractual relationship;
3.1.8. uploading of content that affects and/or contains a patent, trademark, trade secret, brand name, copyright and related rights, as well as other intellectual rights owned or legitimately used by third parties;
3.1.9. uploading of prohibited advertising information and/or spam;
3.1.10. collecting and processing personal data, information about the private life of any person;
3.1.11. violating the normal operation of the Website;
3.1.12. violating Russian or international law.
3.2. You agree not to use profanity, obscene and offensive images, comparisons and expressions, including those related to gender, race, nationality, profession, social category, age, language of a person and citizen, as well related to organisations, authorities, official state symbols (flags, army coats, hymns), religious, cultural heritage sites (monuments of history and culture).
3.3. You recognise and agree that the Website has the right (but not the obligation) to refuse to host and/or remove any content available through the Website’s services.
4. Privacy policy
4.1. The terms of the Privacy policy and the relationship between you and the Website related to the processing of personal data are regulated by the Federal Law of the Russian Federation No.152-Fz of July 27, 2006. “On personal data”.
4.2. Privacy policy applies to personal data that the Website has received or may receive from you at the time of registration and/or booking on the Website, and necessary to comply with the Website’s obligations regarding the products/services you purchase and/or your access to the Website’s services.

5. Terms of purchase and delivery of goods
5.1. You can purchase an item on the Website by paying for it in the following ways: cash, credit card, electronic money, a personal mobile phone account, bank transfer, a gift certificate.
5.2. You hereby agree that your chosen payment method is not subject to change from the moment you place your order on the Website.
5.3. You hereby agree that confirmation of the order paid for by electronic money, credit card, personal mobile phone account, bank transfer, occurs only after a confirmation of the money withdrawn from the account towards the payment of the order has been received.
5.4. You confirm that payment of the order by electronic money, credit card, personal mobile phone account must be made within 5 calendar days of its registration on the Website. You agree that if you do not pay for the order at the end of the specified period, the order may be cancelled.
5.5. The Website implements deliveries of its products in the following ways: the Website’s delivery service (courier delivery or delivery to a self-collection point), mail delivery by the SDEK service. You have the right to choose any convenient way of delivery in accordance with the terms of delivery to your region/country or based on your preferences.
5.6. You agree that if you cannot transport the purchased goods due to your own fault, including your violation of the period during which you are required to collect the goods, the Website will treat this as your refusal to purchase the goods. In this case, the goods will be returned to the Website, and the order will be cancelled.
5.7. In the event of your rejection of a product, as well as the absence of the product you have ordered, the prepayment received by the Website from you, excluding the Website’s shipping costs, will be reimbursed to you no later than 10 calendar days from the date of request.

6. Responsibility
6.1 The Website’s services may contain links to other resources. You recognise and agree that the Website is not responsible for the accessibility of these resources and their content, as well as for any consequences related to your use of the content of these resources.
6.2. You also agree that the Website is not responsible for your personal information, which you provide to third-party resources and/or other third parties when clicking through to them from the Website.
6.3. You confirm that the Website is not responsible for the possible loss and/or damage of data that may occur due to your violation of the provisions of this Agreement, as well as improper access and/or use of the Website’s personalised services.
6.4. Responsibility for the actions of minors, including their purchase of goods from the catalogue on the Website, rests with legal representatives of these minors.
6.5. You agree that if the Website fails to comply and/or improperly fulfils its obligations to sell and/or deliver the products to you in connection with your provision of inaccurate and/or invalid data about yourself, as well as your failure to comply with the terms of this Agreement, the Website bears no liability.
