This document is a public offer of the online shop “NHI SHOP” for the sale of goods
1. General provisions
1.1. This public offer (further — Offer) is an official offer of ANO “NEW HOLLAND” to any individual to conclude with ANO “NEW HOLLAND” a contract of retail sale of goods on the Website remotely according to the terms defined in this Agreement and contains all the essential conditions of the Offer.
1.2. Purchase by the Buyer of goods offered on the Website indicates that the Buyer agrees with all the terms of this Offer, Privacy Policy and User Agreement.
1.3. The Website has the right to make changes to the Offer without notifying the Buyer.
1.4. The duration of the Offer is not limited unless otherwise stated on the Website.
1.5. The Website provides the Buyer with complete and reliable information about the product, including information about the main consumer properties of the product, the place of manufacture, as well as information about the warranty and expiration date of the product in the “Catalogue” section of the Website.
2. Subject of Offer
2.1. The Website undertakes to deliver to the Buyer goods intended for personal, family, domestic or other non-business use on the basis of the placed Orders, and the Buyer undertakes to accept and pay for the Goods in accordance to the terms of this Offer.
2.2. Product description, price, quantity of goods, as well as other necessary conditions of the Offer are determined on the basis of information provided by the Buyer at the checkout.
2.3. Ownership of the ordered goods is transferred to the Buyer from the moment the goods are factually transferred to the Buyer and the latter pays the full value of the goods. The risk of accidental death or damage to the goods passes to the Buyer from the moment of the factual transfer of the goods to the Buyer.
3. The cost of goods
3.1. Prices for goods are determined by the Seller unilaterally indisputably and are listed on the pages of the online shop, located on the Internet at: https://shop.newhollandsp.com.
3.2. The price of the goods is specified in rubles of the Russian Federation and includes a value-added tax.
3.3. The final price of the goods is determined by a consecutive application of discounts in the following order:
- Promotional discount
- Promotional code discount
- Loyal Customer discount
3.4. Payments between the Website and the Buyer for the goods are made in ways listed on the Website in the “Payment” section.
4. The moment of Offer’s conclusion
4.1. The acceptance of this Offer (agreement) is considered to be the Buyer’s registration of an order of the goods in accordance with the terms of this Offer. The Buyer’s order of the goods is carried out through the actions listed in “Payment”, “Your Account”, “Shopping Cart”.
4.2. Accepting the current Offer, the Buyer agrees that:
- registration data (including personal data) is provided by him voluntarily;
- registration data (including personal data) is transmitted electronically through the Internet;
- registration data (including personal data) is transferred to the Website to meet the objectives of this Offer, the Privacy Policy, the User Agreement and may be passed on to third parties for the purposes specified in this Offer;
- registration data (including personal data) can be used by the Website to promote goods and services through a direct contact with the Buyer via communication channels;
- in order to further protect against fraud, the Buyer’s registration data (including personal data) may be transferred to the bank that has been nominated to pay for the placed orders;
- the Buyer’s consent to the processing of his registration data (including personal data) is indefinite and may be withdrawn by the Buyer or their legal representative by submitting a written request to the Website.
5. Return of goods and cash
5.1. Return of goods is carried out in accordance with the Russian Consumer Protection Act.
5.2. Refunds are made by returning the value of the goods paid to the bank card or by a mail transfer.
6. Delivery
6.1. Delivery of the goods to the Buyer is carried out according to the deadline agreed by the Parties when the order is confirmed by the Website’s representative.
6.2. In case of courier delivery of the goods, the Buyer has to put his signature in the delivery registry next to the items the Buyer has purchased. This signature confirms that the Buyer has no claims to the completeness, quantity and appearance of the goods.
6.3. After receiving of the goods, claims to the quantity, completeness and appearance of goods will not be accepted.
7. Duration of the Offer
7.1. The current Offer takes effect from the moment it is accepted by the Buyer and is valid until the acceptance of the public Offer is withdrawn.
8. Additional conditions
8.1. The Website has the right to transfer or otherwise re-assign its rights and responsibilities arising from its relationship with the Buyer to third parties.
8.2. The Website and its services may be temporarily, partially or completely unavailable due to preventative work or any other technical reason. The Technical support of the Website has the right from time to time to carry out the necessary preventive work with or without prior notification of Buyers.
8.3. The relationship between the Buyer and the Website is ruled by the provisions of Russian law.
8.4. In the event of questions and claims on the part of the Buyer, he must contact the Website by phone or in any other manner accessible to him. All disputes will be resolved by the parties through negotiations, if the agreement is not reached, the dispute will be referred to the judicial body in accordance with the current legislation of the Russian Federation.
8.5 The court’s recognition of the invalidity of any provision of this Agreement does not invalidate the rest of the provisions.
